The purpose of this legal blawg is to provide up-to-date information about California case law and developments concerning mediation and arbitration -- the two most common varieties of "alternative dispute resolution" (ADR). For me, this blawg is a natural offshoot of another project, California Attorney's Fees, to which I am a co-contributor, along with my long-time colleague Mike Hensley. As the Mission Statement of California Attorney's Fees notes, attorney's fees are often (too often) the "tail that wags the dog" of litigation. Hence, my interest in ADR as an alternative that, at its best, is more efficienct and economical, as well as less painful, than a lawsuit. The subject of ADR is well worth ongoing exploration and discussion -- and I invite reader's comments.
